�CC� Addendum to report 03186300 and complaint against �F.�
(6.5.03 refused on 5/14/03 by HPD. In order to get Oakes to give me
a HPD report number I had to sign of a piece of paper not to pursue Fran
or sue the HPD for non-arrest. On 5/31/03 F was boasting about how
well she knew Oakes.)
Yesterday on 5/13/03 filed a complaint with Ofc. R. Oakes police report
#03186300 / Assault 3rd. against �F�.
Only Ofc. R Oakes responded and who knows L and convinced me not to press
charges against his girlfriend F. Ofc. R. Oakes didn�t even take down
a report.
(6.5.03 Later realized that L did a one-button dial on his cell phone
and that it is usual for HPD to send more than one officer to an assault
case)
The only statement I signed was that I was dropping the charge and that I
couldn�t sue the HPD if harm shall come to me as a result on nonarrest. No
punitive action was taken against F.
Between O and S advising me to; ��Give her two weeks to apologize�don�t
get her mad�� is a classic example of excusing an abusive and violent person
of their behavior. I did nothing to justify her blows and kicks. It doesn�t
matter who �makes her angry� because she is a habitual fighter. A fact that
both S and O admitted to.
When arrived at to assist S I got the impression off the bat
that I was being blamed for something because when went downstairs, Fn
asked S, �Is that her?�; I agree with Ofc. R. O that
�F will liven up the place, you know what I mean?� I take his judgment
as an expert on habitual violent criminal behavior.

date of 5/13/03 for unit C. I signed a BLANK DATES rental and I never received
a copy - even through have given numerous verbal requests to you

Thursday 15 Got keys for studio.
Friday 16 Painted bathroom. Steamed cleaned rug with S Hoover. K supplied paint to me.

Repair request list of the following please rectify in a timely manner acting
in good faith please.
1 Window glass slat missing, please give me a replacement to install.
2 Electrical outlet in Kitchen has bad wiring. Kitchen ceiling light breaker
is off at the wall for safety. Request licensed electrician to repair outlet
wiring.
3 Electrical outlet in bathroom needs to be finished with outlet and outlet
cover.
4 I was promised a kitchen counter will be installed to replace to rotten
one that was taken out.

Apartment Inventory of apartment C when keys were given to me on the 15th
of May was not fit for tenancy and which using the manager�s materials, (other
than deroaching), I supplied the sole labor to fix the place up for livable
conditions.
Windows; - Cleaned and fixed loose glass slats with fixative.
Screens � Cleaned using spray hose in parking lot
Rug � Steamed cleaned rug. Went over again the numerous stains that are permanently
in the rug.
Tile Floor � Numerous deep scratches on kitchen tile.
Walls � Painted walls to cover roach tracks all over and other flaws such
as cracks of roach entry. Still roaches entering through crack and crevices
from the sides of electrical chaseways and outlets. Caulked all the electrical
chaseways from ceiling to outlet and other holes under sinks where the pipes
come in.
Electrical outlets � Removed sticky gunk of dead roach bodies and sealed
roach infested electrical chase ways opening to outlet box in order to stop
reinfestation. Believe the massive roach infestation was the reason the electrical
wiring is now faulty because roach chaff is conductive.
Kitchen counter � decrepit table removed because it was to rotted out to
repair.
Kitchen sink and Bathroom sink � Within 2 days of painting, brown rust showing
through paint. Strip caulked with plastic cover as a proper repair.
5/28/03 9:06:09 AM I�ve just been informed verbally by Kthat I have
until tonight to leave the premises for breaking the lease within two days
of moving in here. I have no idea what K is talking about.
5/29/03 6:36:14 AM I want copy of the lease that that I; still not received
after 2 weeks.
5/29/03 12:55:47 PM In reference to Notice of Eviction which has been served
to me this morning, this letter is notice to you that it is not a proper
notice. In your effort to deprive my right as a tenant without proper
notice violated the Due Process Clause of the Fourteenth Amendment. The main
reasons for Notice of Eviction being improper are:
1) To be proper, a notice must be written and it must give you a specified
amount of time within which to fix the problem. For violation of rules
or lease, it is ten days, 45 days if month-to-month. It was dated 5/28/03
and was effective 5/28/03.
2) Undefined alleged infractions G.5., G.6, G.7. Request more specifics as
to what you are talking about. On the backhand side of the rental lease you
gave along with the Notice of Eviction, it states numerous types of acts.
Please state distinctively the violation and date that I have done whatever
you are accusing me of.
Today is the first time I have possession of the reverse side of the two
versions of rental lease of 6 months. I respectively ask you to please furnish
me with a copy of both sides of the rental agreement that I had signed on
5/15/03. I do not know if I had signed the old version of rental agreement
with there is no clause G.5, G.6, and G.7. The reason why I wonder is at
first gave me old copy that only had G1, 2,3 only along with the notice.
Then five minutes later gave me the other version instead.
(6.5.03 the �correct version� given by Sto me has someone else�s initials
on it.)
I have a property interest in my leasehold and any individual factual
disputes about whether the lease provision was actually violated can, of
course, be resolved in mediation before going to any type of Summary Possession
Court.

duplicity.)
5-30-03
Trying to figure out why this is happening to me - what is the motive.
To shift blame from L damages of apartment onto me. Using me as a patsy
from the start.
Evidence and events:
Newer door because the old one recently was broken.
Earlier in the week asked Sarina about "your gonna fog it right?" Sarina
answered "Oh I don't think is needed, I don't think he has roaches" Later
in the week after I fogged it a second time and still roaches, I was talking
to Sarina about where they are coming from. I said they are coming from the
crack along the electrical chaseways to the socket box.
She lied to me about not knowing about how bad the bugs were. It did not
dawn on me until later that Sarina must have been visiting Larry at his house
and knew the extreme roach infestation. I am irritated that I bean lied to
but not much. Felt it was shabby treatment from a friend and figured that
I would be getting better treatment if I was a complete stranger.
Larry. Officer Oakes put "no injuries in HPD report that was changed to
a yes when I went to pick up copy of report a week after it happened. Unable
to get copy of details and my addendum was rejected because considered 'closed'.
Perhaps they planned that I would leave the apartment in less than two
weeks by simple harassment. The dates of lease I signed were blank and no
copy ever given to me � nor receipts.
When I talked on the Ofcr. R. Oakes 2 weeks later he was unsympathetic
and dismissed my plight of being under siege as my personal problem of not
being able to handle it.
; Felt that I was set up for a fight on 13th in order to deprive me of house
and home. The plan didn�t work because I didn�t fight back.
May14th Marcie in apt. �F� across the hallway said the former tenants were
"no so nice,� loud music and fighting. Tenants of apartment �C� are now living
in apartment �M.�
May16th torn light from Motorcycle. I no longer park my motorcycle
as instructed underneath Kerri and Sarina�s bedroom window.
May 17th Sarina told me lie that a man had attempted to steal moped that
was next to my motorcycle. Sarina and Kerri insisted that I keep my
motorcycle not in the back on my side of the apartment house but underneath
their window to �protect it�.
(6.5.03 S had advised me to take the mirrors off overnight so that would
not be stolen. Overheard K speaking to in gleeful tones about what
Sarina just said to me. L saw me coming down the stairs behind
Kerri�s back and said nothing while glaring at K. Now I know who broke
off the light on my motorcycle while is was parked under K's and S�s
bedroom window.)

that my eviction was planned before I even was to move in! I was writing
as if talking to S))
1. At your place, you said to me that it bounced. I asked you if you have
even deposited it. You said, � I don�t know�.
2. While pulling out your receipt book you informed me that although you
told me that it was $255, a mistake had been made in calculation of rent
because the Excise tax of 10% was not figured in.
3. I argued that that was wrong, that the excise tax of $18 has already been
figured in and that I have a credit of about $5. You then looked into your
rental ledger and stated the Excise tax is 4%, which equals $18.
4. You feigned ignorance on how to figure out how to prorate and said Kerri
gave you the figure. You wrote a receipt of $255, which said that I owed
about $1.75 for the prorated rent of March from the 15th. I was sure that
this was wrong. You tried another formula and said that I owed around $6.70
then again a different way and said I owed about $46!
5. Receipt for $255 which said I owed about $1.75 was still in the book and
not torn off was invalid. You made a big sweeping motion as if to run a slash
through it but did not touch the paper. You said you will write void on it
later. I did not get that copy and left you place because I was late for
an appointment. I asked you to write a receipt for the $255 once again and
to simply place it underneath my apartment door, which still hasn�t been
done as of today.
6. I wrote that first letter on 5-27 because reasonable suspicion had been
established that bad faith was involved. I was worried that you would attempt
to charge me with rent payment arrears with a questionable calculation. Since
I have no copy of rental agreement and no receipt, I was placed in a position
of documenting everything myself.
I was duped from the start to move in - in order to be conned into, with
apartment manager�s permission, fixing this place up for free then kick me
out for doing their job on a bogus infraction of a rental agreement that
they refuse to give me.
8:03_PM Mon 2 June 03 Went to hide my bike and noticed that S was with a
friend in the two empty apartments that are next to mine. Apparently S is
still acting as an apartment manager although S told me S quit and told the
HPD Sat. that S was not the apartment manager. Maybe S doesn't do the books
any more and just gets the apartment ready. I over heard S say; "...we been
here for 13 years and she's trying to get rid of us..."
At one time before May 27, I told K that I am extremely sensitive to enamel
spray paint cans; S already knew that was the major reason I moved
from 1226 Kinau was because it was right across from Schuman Carriage auto
painting.
6/3/03 Daily Harassment from S & K against myself
4:40PM Both S and K came. S was vacuuming apartment �F� and then the
hallway, unreasonably banging the outside of my wall & door with
the vacuum. When I opened the door, Kerri was sitting in the corner
of the balcony while Sarina was vacuuming at my end of the hallway.
This was an extraordinary event to see them clean the hallway - an
act never seen before.
I stood at the street for a couple of minutes and returned back upstairs.
S & K were gone. Only my end was vacuumed around my door.
I walked past my door and onto the balcony where I overheard S & K talking
about me. S was carrying the vacuum. I let my presence be known
- S & K both looked up and knew I was back. S started to say something
brassy so I left the balcony and went back inside.
Five minutes later I hear the �Phish � Phish� sound of an aerosol can from
below the balcony and then an aroma of a distinctly chemical nature was smelt.
8:37PM. Within three minutes of entering my apartment I hear
�Phish � Phish� but longer sprays than previously. From the sound,
it was obvious that painting was not the goal. The spray can sounded
as if it was being sprayed upside down so that no paint could come out but
only the propellant, which has a distinctive chemical smell.
To: Mrs. IIKD
Since I have a TRO, (copy attached), S and Ki are prohibited from entering
my domicile. I understand because of the sticky situation that repairs will
not be forthcoming until upon you return after June 25. Therefore, I would
like to reiterate the repair list:
1 Missing glass slat
2 Electrical wiring (request licensed electrician)
3 Dropping request for kitchen table because I now realize that when Kerri
gave me permission to remove old one that he had no intention of replacing
it and was planning to use removal of kitchen table as false grounds for
eviction in the future.
4 Toilet bowl previously had showed Kerri the missing anchors from toilet
bowl. This will shorten the life of the wax ring seal because entire bowl
is loose.
6/4/03 Around 8:30 PM Apartment �B� was being cleaned out but did not see
by who. I still hide my motorcycle block away from 1804 Poki and have my
bicycle locked off-property to avoid laundry area.
Ma,
I'm going to out last them all. Legally S as acting apartment manager
was supposed to terminate Fout of here as written in the legal document.
The rental situation here is really tight and I don't think I would be able
to find anything at all if move out of here.
No problems with DD around. I rode the motorcycle up onto driveway yesterday
with him on it in order so that he don't have to walk so far All
three were already there. Nobody said a word. L got on his cell phone
and walked away. Although S and F were blocking the way to the back stairs,
they moved silently out of the way so that we can get past them. I said "Thank
You". Other than that not a word was spoken, not a eyeball glaring,
not a mumble of a grumble Perhaps they have already been served the
TRO. If you notice the TRO the words "garage and lawn" are crossed out because
we all live in the same location. Those three are looking pretty bad because
island people are well known to be able to get along because it's such a
small island. Attached is the formatted copy of the letter I sent out to
Irma yesterday. Perhaps the readability is better with the italics and indents
included.
Because I have looked at the copies given to me of tenant rules (backsides
only) and since
((1)) S told the police that IKD had said (this is a lie I believe) that
the "lease doesn't matter"
((2)) I have no copy of front where it does say "no guest for more than three
days at a time or charge $10 for each day stay" But I do recall also that
it says 2 people per studio so that could be inferred to mean if a 3 or more
people per studio then will charge $10/day extra due to increased usage of
water and wear and tear of apartment. Not exact words, - this is what I recall
reading over 20 days ago when I signed a lease I never was given copy of.
((3)) I don't get harassed at all when he's around, so he going to stick
around because I'm not so nervous when he is.
BTW: When went to USPS office yesterday on the table all they had was the expensive kind tracking that lets the receiver know you are tracking. Had to ask for the 75 cheap version (now 90 cents) form hidden behind counter. Maximizing money spent by consumers by hiding the cheap version from them. No advertising, no from readily availible on counter. Even when spoke to postperson at first acted like it don't exist! Ahh government workers!

Went to LASH and spoke with an attorny - he says keep up with the records and if mail anything can use delivery confirmed for 75 cents which doesn't let them know the letters are being tracked. For rent $$ the certified was the correct choice. Says to keep records etc and to write the notes as if you are writing for the JUDGE in court.
Went to district court to apply for a TRO. The clerk said the judge most likey deny becuase no last names. I replied that the cop refused to give me Fran's last name. I only know Sarina's which I amended on the papers. I am not sure what Kerri's name is. I paid the $15 application fee anyway. If rejected perhaps I can get HPD to give me last names (Hah! - fat chance most likely) Anyway what I typed out for the TRO...

I am writing this request for a temporary restraining order against Fran residing at the Mauka/Diamond corner basement unit �M� @ 1804 Poki Street. In association with Fran, I request a TRO against Sarina and Kerri of unit �J� @ 1804 Poki Street, where I also reside at same address on the second floor apartment �C�. The reason why I feel that I need a TRO is because this morning at around 7:15 AM I overheard Fran talking to Kerri, the co-apartment manager residing at apartment �J� about how to bait me into a fight today in the laundry room for malevolent purposes.
On 5/13/03 Reference HPD, report # 03186300 simple assault with injuries sustained. On that date, Fran came up from my blind side and repeatedly assaulted my face until black and blue. Larry Lopez, roommate of Fran living at 1804 �M� Poki did a one-button dial on his cell phone and Officer R. Oakes responded before I was able to dial 911. Sarina and Kerri acted in bad faith when the two of them told me that Fran was to be evicted for physically hurting me, when in fact they hid the facts from Irma Davis, the owner of 1804 Poki, who is currently, is out of state until June 25, 2003.
On 5/27/03, I wrote a letter to Sarina Monroe, co-apartment manager, at 1804 �J�, which included my grievance, was Sarina�s unresponsiveness of enforcement of duties in providing safe premises as required by law in reference to Fran.
On 5/28/03, Kerri & Sarina served me an improper notice to quit apartment as of 5/28/03 on grounds of breaking the lease.
On 5/31/03 around 1PM, Sarina Monroe made a false problem call with Verizon acting as the apartment manager regarding my telephone line. Later that same day Fran & Sarina went to a neighboring property where I parked my motorcycle not even 5 minutes prior. I wanted to hide the location of where I parked the bike because was afraid of property damage. Fran and Sarina had no valid reason to be off the property of 1804 Poki and entering the neighboring property other than for improper purposes. I entered onto neighboring property where my motorcycle was parked. I stopped before they had a chance to do anything to my transportation. Afterwards, I entered the property where I live at 1804 Poki with my motorcycle and Fran & Sarina were loudly harassing me very rudely while I was still sitting in the bike. I parked the bike off property of 1804 Poki. The officer advised me to file a TRO before it can become a criminal matter for the police. Sarina Monroe stated to HPD that she was not the apartment manager.
Overhearing Fran scheming with Kerri as to how and where to entrap me near the laundry room, it is a self evident fact that I am being denied as the legal tenant of 1804 �C� Poki the standard terms of agreement to enjoying the premises and common facilities of 1804 Property. This is a concerted effort of Fran, Sarina, and Kerri to harass me into moving out before owner Irma Davis returns on June 25, 2003. I need a TRO to protect myself of any future attempts of harassment.

At one time before May 27, I told K that I am extremely sensitive to enamel spray paint cans. S already knew that was the major reason I moved from 1226 Kinau was because it was right across from Schuman Carriage auto painting.
4:40PM Both S and K came upstairs and just outside my door today. S was vacuuming opposite the hallway, apartment �F� and then the hallway, unreasonably banging the outside of my wall with the vacuum. When I opened the door, Kerri was sitting in the corner of the balcony while Sarina was vacuuming at my end of the hallway.
This was an extraordinary event to even vacuum the hallway at all. I have never seen them do that before. Leaving my apartment locked, I turned my back to K and walked towards the street side stairs when I realized that S was coming out of apartment C. I was surrounded by hostiles and felt quite defensive about the situation.
I stood at the street for a couple of minutes and returned back upstairs. S & K were gone. Only my end was vacuumed around my door. I walked past my door and onto the balcony where I overheard S & K talking about me. S was carrying the vacuum. I coughed and they both looked up and knew I was back. S started to say something brassy so I left the balcony and went back inside.
Five minutes later I hear the �Phish � Phish� sound of an aerosol can from below the balcony and then an aroma of a distinctly chemical nature was smelt. I tried to give the benefit of doubt at first that perhaps the sound and smell of spray paint could have been from the neighboring property.
That notion was dispelled when I returned later in the evening at around 8:37PM. Within three minutes of entering my apartment I hear �Phish � Phish� but longer sprays than previously. From the sound, it was obvious that painting something was not the goal. The spray can sounded as if it was being sprayed upside down so no paint could come out but only the propellant, which has a distinctive chemical smell.
Growing desperate, S & K are using every dirty trick in the book to legally harass me while hindering the enjoyment of my domicile. They are afraid of being found out by IKD. I just have to stick it out until June 25 when IKD returns from LV-NV. Until then, I can only pray for the shield of God to protect me from harm and loss of possessions.

8:03_PM Mon 2 June 03 Went to hide my bike and noticed that S was with a friend in the two empty apartments that are next to mine. Apparently S is still acting as an apartment manager even though S told me S quit and told the HPD Sat. that S was not the apartment manager. Maybe S doesn't do the books no more and just gets the apartment ready. I over heard S say; "...we been here for 13 years and she's trying to get rid of us..."
Well that's typical isn't it?

Sounds like the same lady I spoke to a week ago. but says she is not the assistant and that the assistant was out of town until June 25.She says "knows nothing". I said becuase 1804 has no apartment manager that I wanted to send rent check return receipt to address - which she confirmed as 925 A - return receipt. "OK, you go ahead and do that".
So no need to call LASH becuase I've been instructed to mail it to 925 A KokoHead by a person who answers the phone at 737-7628.

Yesterday, 5/31/03 Sarina refused to accept check for the rent of June. Yesterday, Sarina Monroe told me that she �quit� and told the HPD that she is not the apartment manager.
Therefore;
If I can't get of anybody then will mail it the rent return receipt to 925 A. Koko Head Ave. Honolulu HI 96816 return receipt on Monday June 2.
